What are market studies?

A market study, as defined in Part 9A of the Competition Law, is a ‘study of factors that may affect competition for the supply or acquisition of goods or services in Jersey’. A market study allows us to assess whether markets are working well for Jersey and how they could work better.

Why do we carry out market studies?

When markets work well, effective competition encourages innovation, efficiency and consumer choice.

Market studies help the JCRA understand how markets work and identify features that may be preventing competition from working effectively. They can also inform public debate, support policy development and help identify opportunities to improve market performance.

The outcomes of a market study can range from a finding that no competition concerns have been identified (sometimes described as a “clean bill of health” for the market) to recommendations aimed at improving market performance. Recommendations may be directed at businesses, policymakers, regulators or other stakeholders.

How do market studies work?

Each market study will differ in its subject matter, stakeholders, analysis and recommendations. While the JCRA follows a broadly consistent approach, we retain the flexibility needed to reflect the specific characteristics of the market being examined.

The JCRA is committed to running efficient and transparent processes that allow effective participation in its market studies. While each study will differ according to its subject matter and scope, studies typically involve gathering information, engaging with stakeholders, analysing evidence and publishing findings. Information relating to individual studies will be published on dedicated case pages.
