What law governs telecommunications regulation?


The Telecommunications (Jersey) Law 2002 governs telecoms regulation in Jersey. Under the Law, a licence from the JCRA is required to "run part or all of a telecommunication system."

What are the JCRA’s duties under the Law?


Our primary duty is to ensure that telecommunications services in Jersey, and between Jersey and the rest of the world, meet current and future demands.

The law requires us to:

  • Protect and promote the interests of users in Jersey by fostering competition.
  • Promote efficiency, economy and effectiveness in related commercial activities.
  • Further Jersey's economic interests.

We also consider:

  • Service accessibility and affordability for businesses and households.
  • Innovation and service quality.

Additionally, we are tasked with monitoring telecommunications services in Jersey and internationally.

Have there been any directions or guidance from the Minister?


Yes, under Article 8 of the Law, the Minister has issued directions and guidance:

  • November 2022: Directions on social and environmental policies to be followed by the JCRA.
  • October 2007: Directions on testing emissions from mobile telecommunications masts. More details are available on our  Mobile Network Masts page.

How does the JCRA regulate the telecoms sector?


Our regulatory activities ensure well-functioning markets by focusing on competition, regulatory, technical, consumer, and social policies.

 

Fixed telecoms

JT (Jersey) Limited (JT) has significant market power in the fixed telecoms sector, and other operators rely on its network. We have conducted market reviews to regulate wholesale markets and promote retail competition in alignment with government policy.

 

Mobile telecoms

In the mobile sector, operators compete directly, so we do not regulate mobile access or pricing.

 

Spectrum and numbering

We regulate spectrum and numbering in collaboration with Ofcom to manage these resources responsibly. More details are available on our Spectrum and Numbering page.

 

Monitoring and compliance

We monitor compliance with the Telecommunications Law and licence conditions. If non-compliance is suspected, we may investigate. For details, refer to the Guideline for Regulatory Investigations.

Is there a government policy framework?


Yes, our work is shaped by the Government's Telecoms Strategy, issued in 2018. This strategy, along with its associated Telecoms Strategy Action Plan, outlines a series of objectives for government departments and bodies, including the JCRA. The Action Plan informs our activities and policy direction on an ongoing basis.
