Case - T-062
The Government has introduced a new legal framework with amendments made to the Telecommunications (Jersey) Law 2002 (the Law) designed to strengthen the security of Jersey’s vital telecoms networks and services. Under the framework, the JCRA receives new powers and duties designed to monitor and manage compliance with the legal obligations being placed on local telecoms providers.

The telecoms security framework gives the JCRA a legal responsibility for seeking to ensure Providers comply with their security duties, which commence on 1 June 2026. This Information Notes explains the Initial Compliance Engagement Programme that the JCRA intends operating in advance of its full Compliance Monitoring Framework described in the Procedural Guidance.

Telecoms Security Procedural Guidance and Resilience Guidance - Response to Consultations

The JCRA has concluded its consultations on draft telecoms security Procedural and Resilience Guidance. Final versions of these documents are available as standalone case files and further information about Jersey’s telecoms security framework and the JCRA’s role, powers and duties can be found here.
The response to consultation document explains responses received and the JCRA’s analysis and conclusions. This includes the outcome of an additional consultation on modifying a section of the Procedural Guidance to accommodate a Government change to establishing which telecoms providers must demonstrate compliance with its Code of Practice.
Non-confidential versions of all consultation responses received are linked to the relevant consultation.

In contemplation of the coming into full effect of the new telecoms security regime under Part 5A of the Telecommunications (Jersey) Law 2002, the JCRA has updated its current Guideline 12A on financial penalties in the regulated sectors. The additional provisions address the new powers the JCRA will be given to impose financial penalties on telecoms providers who fail to comply with their duties in relation to telecoms security, including their duty to provide certain information to the JCRA. The provisions reflect those in the equivalent Ofcom guidance. The JCRA seeks comments on the draft updated Guideline 12A.
