How to report a competition issue


If you are concerned about competition in a Jersey market, or have information about past, current or potential anti-competitive behaviour, we want to hear from you. Please note, we do not step in or advise on individual complaints against businesses.

Please provide:

  • A description of the issue, including its impact
  • Any supporting information or documentation you have
  • Details about yourself and, if relevant, your organisation

We consider all reports seriously. The information you share with us will be used by the Authority to monitor and possibly take action to stop unfair business practices.

Leniency


We operate a leniency policy for businesses willing to end their participation in a cartel.

 

Cartels involve two or more businesses agreeing to act together to restrict or limit competition rather than compete independently. Cartels are a particularly damaging form of anti-competitive behaviour due to the serious damage they can cause to consumers, businesses and the economy. 

 

If a business ends its participation in a cartel and reports it to us, it may benefit from full immunity from, or a significant reduction of, any financial penalty that the Authority could impose for breaches of competition law.

 

The Authority's leniency policy helps us detect and take action against cartels: see Guideline 11 - Leniency Policy.

Whistleblowing


If you are an employee or ex-employee and wish to provide the Authority with information and/or raise a concern about your employer’s possible involvement in anti-competitive or unfair trading practices, please contact us, in confidence at competition@jcra.je.

 

We understand that it may be a significant decision to come forward and report potential wrongdoing or malpractice by your employer. If you contact us, we handle your details and the information you provide sensitively and in confidence. In particular, we would [seek to] conceal your identity from the organisation you are reporting against.

 

If you prefer you can provide information anonymously. This would mean that we are unable to discuss your complaint with you. It may also make it more difficult for us to take action in respect of your concerns, but we will still do our best to investigate if as a result of the information you have reported to us we think there has been an infringement of the competition law.

If you wish to provide your information anonymously you can use the following methods:

 

·        Phone – set your mobile phone to withhold your number

·        Email – set up a new account ensuring the address does not contain your name or other identifying information

·        Letter – unsigned and/or hand delivered.

 

If you have provided us with contact details, someone from the Authority will contact you in confidence to discuss the information that you have provided and the next steps.
