Updates to the Competition (Mergers and Acquisitions) (Jersey) Order 2010

In 2026, changes to the Competition (Jersey) Law 2005 (the Law) will enhance Jersey’s mergers and acquisitions regime. However, for these changes to be fully effective, the current regime set out in the Mergers and Acquisitions (Jersey) Order 2010 must be updated. The 2010 M&A Order establishes the jurisdictional thresholds that determine which mergers and acquisitions must be notified to the JCRA for approval.

 

In January 2026, the JCRA provided advice to the Minister on the appropriate form of the new Order (see below). This advice was reflected in a Government consultation issued on 9 February, with a closing date of 6 March. The JCRA’s response to the consultation has now been issued and is available below. Further updates will be provided on the Government website.

The JCRA has received a request from the Minister (the Advice Letter) for advice to support the updating of the 2010 M&A Order. This paper contains the JCRA’s advice with recommendations which take into account the unique characteristics of Jersey’s markets. It has been published in line with the requirements of Article 20 (4) of the Law.
