Updates to the Competition (Mergers and Acquisitions) (Jersey) Order
Amendments to the Competition (Jersey) Law 2005 (the Competition Law) were passed by the States of Jersey in November 2025 and came into effect on 1 May 2026. The amendments updated Jersey’s competition legislation, ensuring the Island has a modern, balanced legal framework that is supportive to businesses whilst protecting consumer interests.
To fully implement the Competition Law changes in respect of mergers and acquisitions, the Competition (Mergers and Acquisitions) (Jersey) Order 2026 (the 2026 Order) comes into force on 1 November 2026.
Following a public consultation on the implementation of the amendments, the JCRA has reviewed and updated its Guideline on Mergers and Acquisitions to support the effective implementation of the 2026 Order. The updated Guideline and Consultation Response document are published below.

JCRA Response to the Consultation on Implementation of the 2026 Order

In June 2026, the Jersey Competition Regulatory Authority (JCRA) launched a consultation on the implementation of the Competition (Mergers and Acquisitions) (Jersey) Order 2026 (the 2026 Order). The consultation closed on 4 August 2026.
The JCRA thanks all respondents for their engagement throughout the consultation process and for the feedback provided. Where consent has been given, the full consultation responses have been published alongside this document.
This document summarises the responses received to the consultation questions and sets out the JCRA’s analysis and conclusions. Respondents also raised wider observations that fell outside the scope of the consultation questions. These matters are being considered separately and will be addressed in due course.

Guideline on Mergers and Acquisitions

To support the effective implementation of the new merger control regime, the JCRA has updated its Guideline on Mergers and Acquisitions to provide greater clarity, proportionality and predictability for businesses.
This Guideline will come into effect from 1 November 2026, replacing the existing Guideline 8 - Mergers and Acquisitions | JCRA.

Consultation on Implementation of the 2026 Mergers and Acquisitions Order

This consultation considers how Jersey’s updated mergers and acquisitions regime may operate from 1 November 2026 under the Competition (Mergers and Acquisitions) (Jersey) Order 2026 (the 2026 Order).
Through this consultation, the JCRA is seeking stakeholder comments and views on each of the areas discussed and welcomes views on the consultation questions set out within the document.

JCRA Advice to the Minister

The JCRA has received a request from the Minister (the Advice Letter) for advice to support the updating of the 2010 M&A Order. This paper contains the JCRA’s advice with recommendations which take into account the unique characteristics of Jersey’s markets. It has been published in line with the requirements of Article 20 (4) of the Law.
