Licensing Process

Licences

Article 2 of the Telecommunications (Jersey) Law 2002 requires a licence to be held for person(s) who run part or all of a telecommunications system.

Classes of Licence

There are four classes of licence:-

1. a Class I licence is for those telecoms operators that have no discernible impact on the competitive market;

2. a Class II licence is for those applicants without Significant Market Power (SMP);

3. a Class III licence is for those applicants with SMP; and

4. a General Class licence is for cases where there is a need for a licence but where, in the opinion of the JCRA, a formal application is too rigorous for the requirement. There is no need for an application or for notification to be made, but the licensee is required to know the limitations and responsibilities of the General Class licence.

Application Procedures

Class II and Class III prospective licensees are requested to submit details of their 3 year Business Plans and a Competitive Impact Statement that assesses the likely effect of a new entrant into the local telecommunications market. Prospective Class I licensees need only submit 3 copies of the Telecommunications Licence Application Form (a Word version is available here), together with the licence fee, to the Executive Director, Jersey Competition Regulatory Authority, Salisbury House, Union Street, St Helier, Jersey, JE2 3RF.
